QUESTION:
Assalamu Alaikum Ustadz, related to the policy of the qurban committee to give sacrificial animals to non -Islamic neighbors who are around the mosque, as the intention of da’wah and establishing brotherhood of fellow human beings because it is possible that so far the mosque has made discomfort for the non -Islamic. Is this allowed Ustadz? (Handri S)
ANSWER
Wa’alaikumussalam wa rahmatullah wa barakatuh
There are three opinions in this regard.
1. Cannot
This is the opinion of some Shafi’iyah. Imam Sulaiman bin Umar Al Jamal Rahimahullah said:
And if sacrifice will not be valued for it, the eaters are not permitted for him
“If the person in the law is apostate, it is not possible for him to eat his sacrificial animals, because he cannot give to people who do not believe.” (Hasyiyah Al Jamal, 5/259)
The meaning of “absolute” is the whole infidel, both dzimmiy and harbiy, rich or poor, both in compulsory or sunnah sacrifice.
The reasons are:
Because the intention is the path of Muslims who eat it because it is God’s oppression for them, so it is not permitted for them to be able to do it.
Because, the meaning of qurban is to be a love for Muslims by feeding, so it is a banquet from God for Muslims so that it is not legal for them to give it to Muslims. (Ibid)
2. Makruh
This is the opinion of Malikiyah and Imam Laits bin Sa’ad (contemporary with Imam Malik), he lives in Egypt.
Imam ad dusuqi says:
Malik and Al -Laith hated giving Christians the skin of sacrifice. Malik said someone else. I love us
Imam Malik and Al Laits have surrendered to give qurban skin to Christians. Imam Malik said: “Besides them, we love more.” (Ash Syarh Al Kabir, 3/587)
3. Can, especially for Dzimmi infidels
This is the opinion of the majority of scholars. Both Hanafiyah, as Malikiyah, some Shafi’iyah, and Hambaliyah.
In this context, qurban is considered the same as the Sunnah charity body, where all schools agree that the sunnah charity to the Dzimmi infidel.
Imam Ibn Qudamah Rahimahullah Al Hambali said:
Allowed to feed from him people who do not have people who do not have people who do not have a charity body to choose, so they are allowed to give it dhimma and prisoners, as a charity body
Allowed to provide food from (sacrificial meat) to people who do not believe …., therefore (qurban) is a sunnah gift. Then allowed to provide food to the Dzimmi infidels (in the protection of Islamic countries) and prisoners, the same as other Sunnah charity bodies. (Al Mughni, 9/450)
At Imam Ad Dusuqi Rahimahullah said:
Allowed to feed from him a infidel, and with this, al -hassan, Abu Thor and the owner of the opinion said
It is possible for people who do not believe in eating from him (sacrificial meat), this is the opinion of Al Hasan, Abu Tsaur, and Ashabur Ra’yi (followers of Abu Hanifah). (Ash Syarh Al Kabir, 3/587)
Imam Ad Dusuqiy himself- even if he is a Malikiy- allows him not to believe dzimmiy. He says:
And we have the food he has eaten, so it is allowed to feed dhimmi like all his food, and because it is a voluntary charity body, so it’s more like all the body of charity than volunteers.
For us that qurban is food for him and can eat it, it can give qurban to infidel dzimmiy as other food, because this includes the sunnah charity. Therefore, this is similar to other sunnah charity bodies. There are also deeds that cannot be given to people who do not believe. (Ibid)
Some Shafi’iyah, such as Imam An Nawawi Rahimahullah, said that the stipulation of the Shafi’i school of schools is permissible:
From Majmu Nawawi:
And it is necessary that their food is permitted from victims of volunteers without mandatory and God knows
And that is the provision of Sheikh Madzhab, it can give them (infidel dzimmi) from the sacrifice of the sunnah, not from the compulsory sacrifice. Wallahu a’lam. (Al Majmu ‘Syarh Al Muhadzdab, 8/425)
Opinion may, is the most appropriate and realistic opinion at this time in the midst of equitable difficulties experienced by citizens. Plus, it can be worth preaching to non -Muslims.
Even on the side of his abilities, Allah Ta’ala does not forbid Muslims to do good to peaceful infidels for Muslims, Allah Ta’ala says:
God does not forbid you from those who do not perish in religion, and do not bring you out of your mind that you will be justified and they will be blessed with them for the sake
God does not forbid you to do good and be fair to those who do not fight you in religious matters and do not get you from your hometown. Indeed, God loves those who are just.
(Surah Al-Mumtahanah, verse 8)
Reinforced by the hadith:
And for the authority of the Mujahid: “God’s servant Ibn Amr was slaughtered for him in his family, and when he said, he said: I gave us to our way? I heard God’s messenger
From the mujahid, Abdullah bin Amr slaughtered a goat for his family. When he came to ask, “Did you give a gift to our Jewish neighbors? Did you give our neighbors a gift?
