The Difference Between Wara’ and Waswas in Jurisprudence

In religious practice, quite a few people think that the more they abandon doubtful matters – even those whose origins are permissible -, the higher their level of piety will be. At this point, the term after’ is often claimed, but what actually happens is anxiety. Jurisprudence does not look at this matter from mere outward impressions, but from the basis of the arguments, rules and methodology of legal determination. Because, between after’ and anxiety there are fundamental differences, both in concept and legal implications.

Definition after’ according to scholars

Linguistically, after’ means restraint. As for the term, the ulama define it as an attitude of staying away from cases that are clearly or strongly suspected to lead to what is haram, based on valid arguments or indications.

A fad Rahimahullah said,

Taqwa means abandoning doubts and being aware of forbidden things.

“Wara’ is leaving suspicious things and being careful of haram things.” (al-Majmu’, 1:28)

The Prophet ﷺ said,

Whoever avoids doubt, then he has purified his religion and honor.

“Whoever protects himself from suspicious things, then he has purified his religion and honor.” (HR. al-Bukhari no. 52; Muslim no. 1599)

This hadith is the main basis after’, but it does not stand alone, because doubt in fiqh is not just “feeling doubtful”, but has a recognized basis for ijtihadi.

Facts about anxiety and its legal status

Waswas differs substantially. This is not prudence based on science, but rather doubt that arises without reason, is repetitive, and difficult to control.

Ibn Qudāmah Rahimahullah confirm,

Obsession is a disease that destroys religion and drains the energy of religious people.

“Waswas is a disease that destroys religion and tires people who worship.” (al-Mughni1:164)

In many chapters of jurisprudence —thaharah, prayer, and muamalah—the scholars agree that waswas should not be used as a legal basis.

Ash-Syāṭibī Rahimahullah state,

Obsessive beyond duty

“Wawas is outside the realm of sharia law.” (al-Muwāfaqāt2: 127)

Ushul jurisprudence scales: Yesknot lost because of doubt

Ushul fiqh provides strict rules,

Certainty is not lost because of doubt

“Faith is not lost because of doubt.”

This rule becomes a barrier between after’ and anxiety. after’ working in questionable areas mu’tabarah (which is acknowledged), while anxiety lives from doubts that have no scientific basis.

As-Suyuṭī Rahimahullah said,

This rule is a good basis for rejecting whispers.

“This rule is a great principle in rejecting anxiety.” (al-Ashbāh wa an-Naẓā’irmatter. 60)

When after’ transformed into tasyaddud

after’ that which is not controlled by knowledge has the potential to turn into tasyaddud (being too rude). The Prophet ﷺ said,

The stupid ones perish

“Woe to those who exaggerate.” (HR. Muslim no. 2670)

A fad Rahimahullah interpret,

They are people who delve into problems without knowledge.

“They are people who study religious matters without knowledge.” (Muslim Syarḥ Ṣaḥīḥ16:221)

Sheikh ‘Abdullah bin Bayyah hafizahullah write,

Piety is tied to knowledge, and if separated from it it will become an obsession.

“Wara’ must be attached to knowledge, if you are separated from it you will become anxious.” (Ṣinā’at al-Fatwāmatter. 145)

after’ is light for a knowledgeable heart, while anxiety is a burden for a soul that doubts without foundation. One brings closer to Allah with calm, the other distances with fatigue. Jurisprudence is not present to add complexity to life, but to organize caution in order to stay on the path of propositions. Therefore, not every “more careful” attitude is worth mentioning after’. Reason after’ True truth is always born from knowledge, not from immeasurable fear.
