Want to ask in connection with pilgrimage. Is Mabit on Mina on Tasyrik Day?
Qadarullaah our hotel is close to Jamarat and far to the Mina tent. So the plan is we will stay in the hotel, to Jamarat when throwing jumrah. The government also has a tanazul mina program for worshipers whose hotels are near Jamarat. Please explain Ustadz. (+62 816-963-xxx)

The scholars agreed that the mabit in Mina was prescribed in the hajj series. It’s just that they have different opinions; whether mandatory or not.

The majority of scholars (jumhur) from the school of Maliki, Syafi’i, and Hanbali argue that the mabit in Mina is mandatory in the pilgrimage. If someone leaves it without aging, then he must pay DAM (fines) in the form of slaughtering a goat.

The Hanafi sect stated that the mabit in Mina was the sunnah of miracles, and was not mandatory. This is also the opinion of Hasan Al Bashri, Ibn Abbas, and many more. But it is still advised not to lag behind without reason.

The scholars of this era have also different opinions. Between those who still require such as:

Mabit (overnight) in Mina is a problem that is disputed by the scholars. Some of them argue that the Mabit is mandatory, and this is a stronger and more correct opinion, because the Prophet ﷺ overnight in Mina and he said: “Take my rituals (procedures for Hajj).” He gave al-Abbas relief and herders not to mabit: al-Abbas because of the task of giving drinking pilgrims, and herders because they had to take care of livestock at night. So, when he gave them relief only to them and not to others, this shows that the Mabit is mandatory for them. This is a stronger opinion.

Some scholars indeed argue that the Mabit is not mandatory, and this opinion is narrated from Ibn Abbas, but the validity of the history from Ibn Abbas still needs to be reviewed.

So what is more important, stronger, and closer to the truth is that the mabit in Mina is mandatory for pilgrims. (FATAWA NUUR ‘ALAD DARB)

While the saying that the Mabit in Mina is Sunnah – not mandatory – like Al ‘Allamah Yusuf Al Qaradhawi Rahimahullah, he said in his fat on his website:

Anyone who is unnecessary or interest to leave last night in Mina, then he can remain in it in the Prophet, hopefully God’s prayer and peace is on it. This is despair that is needed to ask for desires, and not ask for mandatory for what I see.
And anyone who is difficult to stay at Mina, or has the need or interest not to live in Mina, there is nothing wrong with that. There is no evidence that shows obligations. And the proverb, hopefully God’s prayer and peace is on it: “Take your ritual from me.” The hadith is more like the hadith “pray when you see me authentic” and with this is in prayer what is an obligation, what is a task, and what is desired.

So whoever has no need or interest to leave the mabit (overnight) in Mina, then it is left for him to stay there, emulating the Prophet ﷺ. In my opinion, this is a form of example that is ordered in the framework of sunna, not an obligation.

As for those who find it difficult to mabit in Mina, or have certain needs or interests not to mabit there, then it is okay for him (not to mabit). Because there is no argument that shows that the mabit is mandatory. As for the Prophet’s words ﷺ: ‘Take from me your rituals,’ does not show that all actions in the pilgrimage are mandatory, because in it there are pillars, obligations, and sunna.

This hadith is similar to the hadith: ‘Pray as you see me praying,’ whereas in the activity of prayer there are fardhu, mandatory, and the sunnah. (finished)

It could be that the government program for Tanazul Mina for some worshipers whose hotels near Jamarat took the view of the party who was presenting because of the presence of intentions and benefits for them.
