Assalamu alaikum wr-wb… Ustat, let me ask about magic and shamanism..
1. Can we kill the perpetrators of separation magic and the perpetrators of disease magic?
2. What are the limits in Islam in responding to perpetrators of magic?

Wa’alaikumussalam Wa Rahmatullah Wa Barakatuh

1. The jurists agreed on the infidelity of the witches, and the death penalty for them.

What scholars differ on is whether the death penalty is due to apostasy or because it is a punishable criminal offense has.

Imam Ibn Taimiyah informed:

Most scholars are of the opinion that shamans are infidels and must be killed, and the killing of shamans has been proven on the authority of Umar bin Al-Khattab, Uthman bin Affan, Hafsa bint Omar, Abdullah bin Omar, and Jundub bin Abdullah.

“The majority of scholars are of the opinion that the shamans were infidels who had to be killed. It has been established (in history) that the shamans were killed by ‘Umar bin al-Khatthab, ‘Uthman bin ‘Affan, Hafshah bint ‘Umar, ‘Abdullah bin ‘Umar, and Jundub bin ‘Abdillah.” (Majmu’ Al Fatawa, 29/384)

Those who have authority are state leaders and their apparatus, not individuals or community institutions, as Imam Ibnu Kathir said:

No one has the right to kill him, but that is up to the priest or his representative

So it was not one of the people who killed him, but rather the priest or his representative (officials). (Tafsir Al Quran Al ‘Azhim, 2/373)

2. The same as responding to other evils. As stated in the Sahih Muslim hadith:

Whoever of you sees an evil, let him change it with his hand; if he is unable, then with his tongue; and if he cannot, then with his heart, and that is the weakest in his faith.

Whoever among you sees evil should prevent it with his hand. If he is unable, he should prevent it verbally, if he is unable, he should prevent it with his heart. That is the weakest faith.

Change it by hand, which means change it by force, power and authority.

If you are unable, then verbally, namely advice and warnings.

If you can’t do that, then with your heart you can show your disapproval, dislike, displeasure and hatred in your heart.
