Breaking the Fast to Save a Drowning Person

Question:

A person who was fasting in the month of Ramadan saw on one of the beaches that a fisherman was struggling against drowning. He felt he was physically too weak to save her if he didn’t eat something to gain the strength to help her. Is it permissible for him to break his fast for this purpose? May Allah reward you with goodness.

Answer:

Praise be to Allah, Lord of the worlds. Shalawat and greetings are bestowed upon the people sent by Allah as a mercy for the whole world, as well as to their families, friends and relatives until the Day of Judgment. But not.

Whoever is unable to save a person who is about to perish due to drowning or other reasons except by breaking the fast, it is obligatory for him to break the fast to save him. It would be a sin not to do this. However, he is obliged to complete his fast, and is not obliged to pay fidyah. (Al-Majmu’ by An Nawawi, 6: 329)

Because, the person who saves a drowning person is seen as someone who is in an emergency like the person who wants to drown himself. Like sick people and travelers who are obliged to do qadha but are not obliged to pay fidyah based on the word of Allah. Exalted (which mean), “Whoever of you is sick or on a journey, then (must replace it) on another day.” (QS. Al-Baqarah: 184)

It should also be noted that a person who is able to save another person because of the available means and causes of rescue such as a boat, rope, or the like which are within his ability, but he deliberately does not use them, then he is guilty of abandoning them. And according to the opinion of the stronger of the two scholars, he is obliged to bear it Just that (compensation for death) of that person.

This is because leaving something (in a state of being able to do it) is essentially considered an act, as has been determined in the discussions of the ulama.

Ash-Syinqithi May God forgive him provides many examples in various branches of law from various schools of thought. He said, “Like a person who withholds excess food or drink from someone who really needs it until he dies. If “abandoning” is considered an act, then he is obliged to bear Just that-his; but if it is not considered an act, then there is no responsibility for him.

Likewise, the person who holds the thread from someone who has a big wound until he dies; people who withhold excess water from their neighbors until their crops are damaged; a person who deliberately does not help the owner of a wall that is about to collapse until the wall collapses; or the person who holds the letter of right until the right is lost. There are many examples like this in the branches of jurisprudence. If abandoning him is considered an act, then in all cases he is the one who is responsible.” (Al Faiq1: 246)
