Peace be upon you, and Allah mercy and blessings? Afwan Permission to ask Ust. related to Home Mortgage law.
Bismillah, a husband who is paying off the mortgage for his parents in installments. However, as time went by, he felt that his salary was not enough because he had to share it with his family’s income. He is experiencing a dilemma between worrying about making his parents angry/hurt if he stops the mortgage installments, and the lack of support that he should provide to his family. Please explain regarding KPR law and which one should take priority? Shukron
ANSWER
Wa’alaikumussalam wa Rahmatullah wa Barakatuh
In the context of sustenance, children and wife must come first… As in the letter An Nisa: 34
Men are responsible for women, because Allah has preferred some of them over others, and because of what they spend from their wealth, so that good deeds are sufficient. You have guarded the unseen with what Allah guarded. As for those whom you fear will disobedience, rebuke them, leave them in their beds, and beat them. But if they obey you, do not seek recourse against them. Indeed, Allah is Most High, Most Great.
“Men (husbands) are responsible for women (wives) because Allah has preferred some of them (men) over others (women) and because they (men) have spent part of their wealth. Pious women are those who are obedient (to Allah) and take care of themselves when (their husbands) are not around because Allah has taken care of (them). Those women who you are worried about will be nusyuz, give them advice, leave them in bed (separate beds), and (if necessary,) beat them (in a way that is not painful). However, if they obey you, do not look for ways to cause trouble to them.
also hadith:
One dinar you spend for Allah, one dinar you spend on a servant, one dinar you give in charity to the poor, and one dinar you spend on your family. The greatest reward is what you spend on your family.
Dinars that you spend in fisabilillah, dinars that you spend to free slaves, dinars that you use to give alms to the poor, and dinars that you spend on your family, then the greatest reward is the dinars you spend on your family. (HR. Muslim No. 995)
Meaning Al Ahl with words WELCOME, are wife and children.
However, in the context of doing good and being kind, a son never stops doing good to his parents. It is an obligation. However, there are many forms of service, including buying a house to the best of your ability, or in other ways.
Children and wives are the responsibility of the husband and father. It cannot be handled by others if the husband/father is still alive.
There are also parents who are handled by all their children if the parents are no longer able, not just one child. Therefore, taking care of your parents is a means of competing in goodness, while providing for your wife and children is a means of carrying out your obligations.
The mortgage itself, if it is with a sharia mortgage agreement, is okay. Because the contract is a sale and purchase, not an interest-bearing loan. With conventional mortgages, the contract is an interest-bearing loan and this is not allowed.
