Get to know the definition of “Jurisprudence Rule”

The rule of fiqh is one branch of science compiled by the scholars to tread the stairs in knowing and understanding fiqh. In short, by knowing the rules of fiqh made by the scholars, it will be easier to understand the discussions of fiqh contained in Shari’ah This. In addition to the science of fiqh who can help to understand the discussions of fiqh, the rule of fiqh is no less important for the prosecutors of science. The science of fiqh rules aims to support the sciences tool others to understand Shari’ah This.

Definition of Jurisprudence

Before moving further, so that it is easy to understand about the rules of fiqh, it’s good we move from the definition. The benefits of knowing the definition are certainly very much, including uniting perceptions so that it is easy to understand the branch of science you want to learn.

It should be noted that the term “fiqh rules” is a combined term consisting of two words “rules” and “fiqh”, or in Arabic commonly referred to as Jurisprudence rules (Al-Qowaid Al-Fiqhiyah).

Therefore, by definition, the rule of fiqh is divided into two parts:

First: Definition of Jurisprudence when seen as a combination of words (compound terms).

Second: The definition of fiqh rules when viewed as a form hose (naming certain disciplines).

First: Definition of “Rule of Jurisprudence” when viewed as a combination of words (compound terms)

As explained, that the rule of fiqh consists of two words, Jurisprudence rules namely the word Al-Qowaid and words Al-Fiqihiyah.

Definition “Qawa “Ed” or “rules”

Base (Al-Qowaid) in language is a plural form of Alas (rules). The word is taken from three Arabic letters, namely, ق ع د which means settled and stable. However, the closer meaning can be interpreted that the rules are main foundation.

Among what shows that meaning is the word of God Tap,

And if Abraham raised people from home and hears

“(Remember) when Ibrahim raised the foundation of Baitullah with Ismail …” (Surah Al-Baqarah: 127)

And also the Word of God Story,

God comes to their children from the champion

“So, God destroyed their homes starting from the foundation …” (QS. An-Nahl: 26)

The connection between this matter in meaning, that the laws are built on the rules (foundations) as the walls (houses) are also built on the foundation.

Meanwhile “Rule” in terms is,

Total case

“A comprehensive statement (universal).”

Namely, a case that is comprehensive (universal) that includes various branches.

Definition of “Jurisprudence”

Language, meaning “fiqh” is Understand (understand).

Allah Story said,

They say: What do you think about what expenditure Many of what you say, and we will see you in weaknesses ۗ

“O SYUʻAIB, we don’t have much understand What do you say, while we see you as a weak person from us. ” (QS. Hud: 81)

There is a term, “Jurisprudence” is,

Knowledge of legal decisions obtained from detailed evidence

“The science of sharia laws that are amali, which are attracted from detailed arguments.”

It is clear that matters relating to “fiqh rules” if defined in accordance with the combination of words.

Second: Definition of “Rule of Fiqh” when seen as a form hose (naming certain disciplines)

In fact, not many of the scholars who define the rules of fiqh as a form hose or naming for certain disciplines. From the definitions that have been described above, it is important to note that the scholars do not go to the definition hose Jurisprudence of Jurisprudence. However, the scholars mention only limited to the definition of “rules” without defining it hose.

When talking about specific definitions about hose The rule of fiqh, can be said that almost not found among the previous scholars who defined this knowledge. However, there is a definition that is right to be used as a definition of fiqh rules. The following is a definition conveyed by Dr. Ya’qub al-Bahusain Rahimahullah. He said,

The case of jurisprudence tertiary institution, its part is the problem of jurisprudence universities

“A comprehensive statement is related to fiqh, whose parts include various fiqh problems.”

That is, as part of the rules is includes various fiqh problems.

His student, Prof. Dr. Musallam bin Muhammad Ad-Dusary, also defines the science of fiqh rules,

Jurisprudence of Total Problems which partially represents some of the Fakih College problems

“Comprehensive statements related to fiqh, which each branch part represents the general rules of fiqh.”

For example, there is a fiqh rule that sounds,

Difficulty carrying facilitation

“With difficulty having facilities.”

This is called the rule of fiqh. From this rules there are fiqh problems that can be resolved with this rule. Like, people who cannot perform prayers in a state of standing because they are sick. The problem can be answered with this rule, “Together with difficulties there is ease”; namely please perform the prayer in a sitting state.

Or people who are fasting, he is unable to carry out Ramadan fasting because he is being hospitalized. He needs to eat and drink. This can also be answered with the rule of fiqh that the scholars have mentioned, “Together with difficulties there is convenience.” Please just break the fast, eat and drink because you really need it. Later on, please toQadha ‘ Fasting is due to breaking (not fasting) during the month of Ramadan. This is one form of an example of applying for fiction.

In essence, learning about fiqh rules is an important thing. As a support to make it easier to understand fiqh and answer problems related to practical fiqh.
