Witir prayer directly after the evening prayer before the Ba’diyah Isha prayer

QUESTION:

Can the Witir prayer be done immediately after the evening prayer? (From the 2T community, taata and recitations)

ANSWER

Bismillahirrahmanirrahim ..

Witir prayer has been allowed since after the evening prayer. Even though someone hasn’t prayed Ba’diyah Isha.

Al ‘Allamah Yusuf Al Qaradhawi Rahimahullah explained:

Legal experts agree that the time of Witr prayer after the evening prayer until the second dawn, for the hadith Abdullah bin Amr bin Al -Aas, for the authority of Abu Basra Al -Ghaffari: Prophet ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ ﷺ

The fuqaha agreed that the time of the Witir prayer began after the evening prayer until the second dawn (dawn shadiq), based on the hadith from Abdullah bin Amr bin al-‘ash, from Abu Basrah al-Ghifari, that the Prophet ﷺ said: “Indeed, Allah has added to you one prayer, namely Witir. (HR. Ahmad, Sahih) (Fiqhush shalah, p. 330)

In Al Mausu’ah it is said:

It is a prayer carried out between night prayers and dawn dawn, who ended the evening prayer, calling this because it prayed the tendon, one rak’ah, three, or more, and not allowed to make it an intermediary

Witir is a prayer that is done between the evening prayer and the publication of the dawn, with the night prayer is closed. Named Witir because the prayer is performed witir (odd), 1 rak’ah, or three, or more, and may not make it even. (Al Mausu’ah Al Fiqhiyyah Al Kuwaitiyah, 27/289)

Even if the plural between Maghrib and Isha in Maghrib, he can pray after his prayer. Imam Ibn Qudamah said:

And if a Muslim prays dinner, travel meeting, illness, or other reasons, then when the tendon comes in from when he prays dinner

“If a Muslim performs evening prayers with plural takdim due to safar, illness, or other aging, then the time of the Witir Prayer has entered since he performed the evening prayer.” (Al Mughni, 2/595)

But the end of prayer at the end of the night is more important. Rasulullah (may peace on it) said:

Which of you are afraid that he will not rise from the end of the night, don’t let him, so he can stand ready and it is preferred

“Who is worried that you cannot wake up at the end of the night, he should be Witir and then go to sleep. And who believes he will wake up at the end of the night, he should be Witir at the end of the night, because the reading at the end of the night is attended (by angels) and it is more important.” (HR. Muslim no. 755)
